The online store www.fans.lv is owned by SIA “Aqua Pro”, registered with LRUR No. 40103152891, VAT registration No. LV40103152891, Address: Garozes iela 1, Rīga, LV-1004; the physical FANS Prosport stores are owned by SIA “Aqua Pro”, registered with LRUR No. 40103152891, VAT registration No. LV40103152891, Address: Garozes iela 1, Rīga, LV-1004, and SIA “Multisport”, registered with LRUR No. 40003682165, VAT registration No. LV40003682165, Address: Garozes iela 1, Rīga, LV-1004, hereinafter – the Seller.
By using http://www.fans.lv or shopping in FANS Prosport physical stores, including ordering goods and making purchases on www.fans.lv, you, hereinafter – the Buyer, automatically agree to all www.fans.lv and FANS Prosport physical store terms for use, purchasing, payment, delivery, privacy, warranty, warranty refusal and contract withdrawal, hereinafter – the Terms.
The Seller reserves the right to change these Terms of Use without prior notice.
- General provisions
1.1 The use of the online store www.fans.lv does not grant any ownership rights to the content of this site. It is prohibited to use or republish the content posted on the online store www.fans.lv unless you have the permission of the content owner or another type of authorization in accordance with the law.
1.2 The product content, descriptions and other information displayed on www.fans.lv are the property of SIA “Aqua Pro”.
1.3 In connection with the services used, SIA “Aqua Pro” is entitled to send the Buyer notifications and reminders about initiated but incomplete services and other information to the entered email address. SIA “Aqua Pro” is also entitled to send information, including by direct calls, about www.fans.lv, SIA “Aqua Pro” and their partners’ news, promotions and discounts. You have the right to opt out of receiving any news by unsubscribing from news or by sending information to: efans@fans.lv
1.4 Actual product availability may differ from that indicated on www.fans.lv. In cases where the ordered product is not available, or not available in the quantity ordered, and the Buyer refuses to purchase other equivalent or similar products, the Seller reserves the right to cancel the order without compensation to the Buyer, notifying the Buyer and refunding the payment for the order, if such has been made.
1.5 The images of products viewable on www.fans.lv may differ from the offered product. To clarify a product’s characteristics or resolve uncertainties related to its ordering, please contact www.fans.lv by email at efans@fans.lv or by phone at +371 20110013.
1.6 Product prices on www.fans.lv and in FANS Prosport physical stores may differ.
1.7 Ownership of products purchased in the www.fans.lv online store passes from the Seller to the Buyer at the moment of Payment for these products.
- Purchasing and payment terms.
2.1 The sale of products offered on www.fans.lv takes place via an online offer. When the Buyer places an order and makes a purchase, a Distance Contract is concluded between the Buyer and the Seller, hereinafter – the Contract. The terms of the Distance Contract are governed by Article 10 of the Consumer Rights Protection Law of the Republic of Latvia (PTAL) and Cabinet of Ministers Regulation No. 255.
2.2 Orders can be placed in the online store www.fans.lv, by phone +371 20110013, or by email efans@fans.lv.
2.3 Purchases on www.fans.lv can be made either by registering and creating a personal account or without registration.
2.4 All prices are final at the time of ordering and include value added tax (VAT). All prices are indicated in euros (EUR).
2.5 Prices do NOT include delivery costs.
2.6 Payment methods for purchases in the www.fans.lv online store are:
cash – upon receipt of the product in FANS stores
payment card (including Google Pay/Apple Pay) – when making a purchase on www.fans.lv or upon receipt of the product in FANS stores
internet banking transfer – when making a purchase on www.fans.lv
bank transfer to SIA “Aqua Pro” account No. LV16HABA0551040339701, AS Swedbank – when making a purchase on www.fans.lv according to a manually issued and sent invoice (invoice payment term 3 days)
leasing. The Buyer may be either a natural or a legal person.
2.7 After placing the order, you will receive an order confirmation at the email address you provided and, if necessary, the www.fans.lv staff will contact you regarding the delivery details and costs.
- Delivery terms.
3.1 Delivery of products available in the Seller’s warehouse(s) is made within 1–3 working days.
3.2 The cost of order delivery is determined by the product delivery price list.
3.3 Delivery methods are as follows:
- by courier to the specified address
- in any FANS store
3.4 In the case of leasing, the documents can be signed only by the lessee.
3.5 Upon receipt of the product, the Buyer is obliged to ensure that it corresponds to the ordered product and to visually assess the product’s external appearance and packaging. By signing the delivery note, the Buyer confirms that they have received a product that matches the order and in appropriate packaging quality.
3.6 If a product not corresponding to the order is delivered, or if visual defects of the packaging or the product are discovered, the Buyer is obliged to inform the Seller of this fact within 2 working days. In such cases, the Buyer and the Seller will try to agree on one of the following solutions:
The order/purchase remains in force and the product remains the property of the Buyer, but the Seller compensates the Buyer for packaging or product visual defects or the product’s nonconformity to the order.
The Buyer and the Seller agree to exchange the product for one that corresponds to the order. In this case, the Buyer returns the product to the Seller (Aqua Pro SIA, Rīga, Garozes 1, LV-1004) at the Seller’s expense, and the Seller sends the Buyer to the same address a product corresponding to the order at the Seller’s expense within 5 days after receiving the Buyer’s returned product.
The order/purchase is canceled. In this case, the Buyer returns the product to the Seller (Aqua Pro SIA, Rīga, Garozes 1, LV-1004) at the Seller’s expense, and the Seller refunds the Buyer the purchase amount of the returned product and its delivery fee within 5 days after receiving the Buyer’s returned product.
3.7 If the Buyer and the Seller cannot mutually agree on a solution, the Buyer may use the Right of Withdrawal specified in these Terms or apply to the Consumer Rights Protection Centre with an appropriate submission (PTAC form).
3.8 Oversized products and products weighing more than 30 kg are delivered only to the building’s (apartment building’s) front door. In such a case, the Buyer must arrange the product’s carrying into the building (carrying up to the apartment).
- www.fans.lv privacy policy.
4.1 During visits to and use of www.fans.lv, SIA “Aqua Pro” may receive information containing personal data:
- by obtaining personal data directly (name and surname, phone number and email address);
- indirectly, by obtaining information (for example: using cookies and other technical means to monitor the use of www.fans.lv).
4.2 SIA “Aqua Pro” processes Buyers’ personal data in compliance with the requirements set by the Personal Data Protection Law and other laws of the Republic of Latvia regulating the processing and protection of personal data. When processing and storing Buyers’ personal data, SIA “Aqua Pro” uses organizational and technical means to protect personal data from accidental or unlawful disclosure, alteration, as well as from any other unlawful processing.
4.3 By purchasing the products and services offered in the www.fans.lv online store, the Buyer agrees and allows SIA “Aqua Pro” to register, enter, store, systematize, use and process personal data in any other way.
4.4 SIA “Aqua Pro” ensures the protection and security of Buyers’ personal data, and that it is not disclosed to third parties, to the extent required by the Personal Data Protection Law and other laws of the Republic of Latvia regulating the processing and protection of personal data, except to the Seller’s partners who provide the delivery of products purchased in the www.fans.lv online store, product financing and service provision, to the extent that personal data is necessary for the performance of contractual obligations.
4.5 Data compiled and accumulated by SIA “Aqua Pro” in the www.fans.lv online store may also be transferred to third parties for informational and statistical purposes. DATA THAT WOULD ALLOW A PERSON TO BE IDENTIFIED IS NOT DISCLOSED AND IS NOT TRANSFERRED TO THIRD PARTIES IN THIS PROCESS, EXCEPT FOR ORDERS MADE WITH THE PAYMENT METHOD “LEASING” IN WHICH PERSONAL DATA MUST BE VERIFIED.
4.6 SIA “Aqua Pro” does not link a user’s IP address and email address with data that would allow identification of this user. This means that each user session will be recorded, but the www.fans.lv online store user will remain anonymous.
4.7 All materials sent to or entered in the www.fans.lv online store, except personal data, become the property of SIA “Aqua Pro”, which SIA “Aqua Pro”, as the owner of the www.fans.lv online store, is entitled to use for its own purposes.
Cookies
4.8 www.fans.lv uses cookies that provide broader possibilities for using the website and the www.fans.lv online store.
4.9 Cookies are small text files that a web browser (for example: Internet Explorer, Firefox, Google Chrome or Safari) saves on a web user’s computer, tablet or smartphone. In this way, websites can also save a web user’s individual settings. Cookies usually contain information about the website name, the duration of storage on the device and a unique number. Cookies can be considered a way for a website to obtain information that allows it to recognize the user and respond accordingly.
4.10 SIA “Aqua Pro” and its cooperation partners – third parties – may use cookies to analyze www.fans.lv visitors’ interests, behavior, habits, etc. The purpose of this analysis is to provide each www.fans.lv visitor with the most appropriate content.
4.11 By using the www.fans.lv online store, the user agrees to the analysis of their computer’s cookies in order to offer personalized offers.
4.12 Information related to cookies is not used to personally identify the user (Buyer). Cookies are used for the following purposes:
- adapting www.fans.lv to users’ (Buyers’) preferences,
- optimizing the use of www.fans.lv,
- for advertising and marketing optimization purposes, based on interest in certain benefits,
- for compiling statistics on the number of www.fans.lv visitors.
4.13 Cookies do not have to be enabled for the website to function, but cookies provide broader possibilities for using the website. It is possible not to use cookies on www.fans.lv by changing the browser settings or by deleting cookies; however, in some cases, certain function limitations may appear while browsing www.fans.lv.
- Security of the www.fans.lv online store
www.fans.lv uses one of the world’s best-known secure connection protocols – SSL (Secure Socket Layer). This means that data between your computer or smart device and the www.fans.lv server is transmitted in encrypted form. A secure connection can be recognized by the padlock symbol in the browser’s address bar. The SSL certificate version used by www.fans.lv is suitable for protecting online stores where the user makes purchases and provides their data. When paying for an order on www.fans.lv, all payment information is provided to and stored in the database of the company providing these services and is not available to SIA “Aqua Pro”.
- Warranty
6.1 Products purchased on www.fans.lv have a manufacturer’s warranty. The warranty period and conditions for each product are individual.
6.2 Information about the warranty period for a specific product is indicated in the product description or can be obtained by asking a www.fans.lv customer consultant.
6.3 If the Buyer is a natural person, then, in accordance with the Consumer Rights Protection Law of the Republic of Latvia, they have the right to submit a claim regarding a product that does not comply with the terms of the contract within 24 months from the date of product delivery. This term is valid even if the manufacturer has set a shorter warranty period than 24 months for the respective product.
6.4 If the Buyer is a legal person, then, in accordance with applicable laws and regulations, they have the right to submit a claim regarding a product that does not comply with the terms of the contract according to the manufacturer’s set warranty period.
6.5 A warranty claim is valid only for fully paid products and only if a purchase document (receipt, bank payment) and warranty card (if one was issued) are presented.
6.6 The right to submit a complaint is valid only if the product has been used solely for the intended purpose and under the intended conditions.
6.7 The warranty is provided at Fans store service centers.
6.8 The manufacturer’s warranty conditions are not valid in the following cases:
- the product has damaged warranty seals or serial numbers;
- the product has not been used for its intended purpose;
- the product has not been operated or maintained in accordance with the product user manual;
- the product or its part(s) is scratched, broken, cracked, water has entered areas not intended for it, foreign objects have been allowed inside the product, or there are other traces indicating improper operation;
- damage was caused by non-compliance of supply voltage, telecommunications, cable networks with the standards set by the manufacturer, by rapid temperature fluctuations, as well as by other household and external factors, for example, soot, smoke, dust, sand, moisture, impacts, scratches;
- traces of unauthorized, unqualified repairs are visible in the product;
- in cases of natural, normal wear and tear of the product;
- if non-standard power elements, accessories, spare parts, as well as raw or auxiliary materials not certified by the manufacturer for use with the specified product have been used;
- if the product has been used for manufacturing or professional purposes (if the specific product is not intended for such purposes);
- as a result of improper transportation of the product.
- the warranty does not apply to product design elements.
- mandatory regular maintenance specified in the product instructions, warranty card or technical passport has not been carried out for the products (e.g., for bicycles).
6.9 In case of disputes, the Buyer has the right to contact the Consumer Rights Protection Centre of the Republic of Latvia: http://www.ptac.gov.lv/lv/content/pateretaju-stridu-risinasanas-komisija and resolve the situation in accordance with the procedures provided by Latvian legislation.
- Right of withdrawal
7.1 In accordance with the Consumer Rights Protection Law, the Buyer has the right to withdraw from the Distance Contract (purchase on www.fans.lv) within 14 days without stating reasons. The right of withdrawal is valid for 14 days from the moment the Buyer or a third person indicated by the Buyer, who is not the carrier, has obtained possession of the product.
7.2 To exercise the right of withdrawal, the Buyer must fill in an Application for the exercise of the right of withdrawal, send it to the Seller by email: efans@fans.lv and, within 14 days from the date of sending this Application, return the product to the Seller – in Rīga, Garozes iela 1, LV-1004, SIA “Aqua Pro”, on working days from 10:00 to 18:00.
7.3 The Buyer may return the product to the Seller by delivering it in person to the address indicated by the Seller during the specified working hours or by sending it by courier.
7.4 When returning the product to the Seller, the Buyer must ensure appropriate packaging for the transportation of the product.
7.5 The costs of returning the product to the Seller are borne by the Buyer.
7.6 Upon receiving the Buyer’s Application for the exercise of the right of withdrawal, the Seller shall, no later than within 14 days, refund the Buyer the purchase price of the returned product and the cheapest possible delivery method.
7.7 The Seller has the right to withhold the refund to the Buyer until it has received the returned product.
7.8 The Seller refunds the said amount using the same means of payment as used by the Buyer, except in cases where the Seller and the Buyer agree on another means of payment.
7.9 During the period for exercising the right of withdrawal, the Buyer has the right to use the product to the extent necessary to ascertain the nature, characteristics and functioning of the product (to the same extent as would be possible before purchase in a physical store).
7.10 When exercising the right of withdrawal, the Buyer is responsible for use of the product beyond what is necessary to ascertain the nature, characteristics and functioning of the product. The Buyer is directly responsible for use of the product during the withdrawal period that is incompatible with the principle of good faith, as well as for any reduction in the product’s value, quality and safety.
7.11 The right of withdrawal does not apply to Buyers who are legal persons.
7.12 Damages caused by natural conditions are not compensated.
7.13 Products purchased in FANS Prosport physical stores are not exchanged and are not accepted back.
7.14 The right of withdrawal does not apply in the following cases:
- In the cases mentioned in point 7.1 of the section “Delivery terms” of these Terms.
- In the cases specified in point 22 of Cabinet of Ministers Regulation No. 255 of 20 May 2014 “Regulations on Distance Contracts”, including if:
- The product has been manufactured according to the Buyer’s specifications or is clearly personalized;
- The Buyer has opened the packaging of a product which, for health and hygiene reasons, cannot be returned;
- Due to its characteristics, the product will irreversibly mix with other items after delivery;
- the contract is concluded at a public auction.
- Other provisions.
8.1 Any dispute arising between the consumer and the seller or service provider shall be resolved through negotiations, with the parties seeking to reach an agreement.
8.2 If a dispute between the consumer and the seller cannot be resolved through negotiations, the consumer submits a written application to the seller, which must indicate:
- name, surname, residential address and contact information;
- date of submission of the application;
- the essence of the dispute, the claim and its justification.
8.3 Copies of documents confirming the transaction and other documents supporting the application shall be attached to the application.
8.4 If the seller refuses to fulfill the consumer’s claim or the consumer is not satisfied with the solution offered by the seller, the consumer has the right to address:
- the Consumer Rights Protection Centre to receive assistance in resolving the dispute;
- a consumer out-of-court dispute resolver, if such has been established in the relevant field;
- the Consumer Dispute Resolution Commission
- the court.
